End Of Stage Payments
In New Housing Estates

On the 22nd of February 2007 the Minister for Housing
and Urban Renewal announced that the practise of Stage Payments
in housing estates was to cease. Following negotiations with the
Irish Home Builders Association and Officials of the Department
of the Environment, Heritage and Local Government, it was agreed
that the practise would not apply to such houses where contracts
were entered into after the 30th of June 2007. From the 30th of
June 2007, builders who are a member of the Irish Home Builders
Association (IHBA) agreed to no longer use Stage Payments in Contracts
for new houses or apartments. Approximately 80% of builders operating
in Ireland are members of the Irish Home Builders Association. A
complaints procedure has been set up to deal with any complaints
regarding members who break the code.
The effective Stage Payments have been to require
the purchaser in a new housing development to make payments to the
builder at a number of set intervals or stages in line with the
progress of the building. Practise was most common in Cork and some
other areas of the Country and accordingly this change has been
very welcome. Unfortunately, statutory prohibition on stage payments
that would apply to all builders has not however been introduced
and thus Stage Payments can continue to apply in the case of once
off housing development by agreement between the buyer and the developer.
