January 2004 has heralded a new climate for the conduct of commercial
litigation. The new court has also been instrumental in the expansion
of ADR bringing with it the necessary tools to deal efficiently
with these changed circumstances, such as judicial case management,
focused pleadings and agreement by the parties as to what matters
are actually in issue.
